What to Do if You're Detained by the Police or Immigration Authorities

Last updated: March 2009

Whether you are a documented or undocumented immigrant, you still have rights under U.S. and International laws.

If you are stopped or detained by the police, FBI or immigration authorities:

  • DO ask to speak to a lawyer. Immigration authorities should give you a list of low-cost and free legal services in your area.
  • DO NOT sign anything before speaking to a lawyer.
  • DO NOT allow anyone to enter your home unless they have a court order.
  • DO ask to see a judge.
  • DO ask to speak to someone from your home country's consulate (unless you have a fear of being harmed in your home country).
