A paying parent can defend against a Petition for Rule to Show Cause by arguing that they did not violate the court order on purpose. If the paying parent is unemployed, a judge may find that the parent did not violate the order for support.
In these cases, most courts will order the parent to come to court and prove that they are actively trying to find employment and support their children.
Note: Child support must still be paid even if the paying parent files for bankruptcy.
