2. When a VAP has already been signed
If a parent who signed a Voluntary Acknowledgement of Paternity (VAP) wants to undo it, they have to sign a Rescission of Voluntary Acknowledgment of Paternity form, have it witnessed, and send it to the Department of Health and Family Services (HFS). HFS must receive the form within 60 days of the date the VAP was signed.
After the time period for a Rescission has expired, it is very difficult to undo a VAP. The person must go to court and prove fraud, duress, or material mistake of fact. A person should talk to a lawyer if they want to disprove paternity more than 60 days after they sign a VAP.
