A small estate affidavit A notarized written statement signed by a person under oath is a way for someone’s personal property to be transferred when they die without having to go to court. It cannot be used to transfer a house, or other real estate. Property consisting of land or buildings like a house or an apartment When someone dies, and if their estate is small enough, they do not need to go to probate A court process where a person's property is given out after they die court. The probate process can take a lot of time, and cost a lot of money. Using a small estate affidavit is faster and costs less money than going through the probate court.
