Eviction

Eviction is a court process. In Illinois, only the sheriff can evict a person who lives in someone else's property by spoken or written agreement. The sheriff must have a judge’s order to do the eviction. This order can come from:

  • An eviction case brought by the housing provider against people living in the property, or
  • A tax sale or foreclosure case against the housing provider.
