Venezuela's temporary protected status 2023

Warning: Recent policy changes under the Trump administration could significantly affect the Temporary Protected Status (TPS) program. Due to these changes, some of the information on this site may be outdated. If you have TPS, consider speaking with a lawyer to understand your options.

Note: In February 2025, the Secretary of Homeland Security announced the end of Venezuela’s 2023 TPS redesignation. A federal judge temporarily blocked the decision, but on May 19, 2025, the US Supreme Court ruled that the government could move forward while the case continues in the lower courts. As a result, TPS for many Venezuelans is now set to end. 

Temporary Protected Status (TPS) allows people from certain countries to live and work in the United States. The U.S. can grant TPS to countries facing situations such as: 

On September 20, 2023, the U.S. Secretary of Homeland Security extended  Venezuela’s 2021 TPS designation for 18 months. Separately, Venezuela was redesignated for TPS for 18 months, known as Venezuela’s 2023 TPS. 

Current TPS holders based on Venezuela’s 2021 TPS designation can maintain their TPS through September 10, 2025, if: 

  • They continue to meet the eligibility requirements, and
  • Re-register. 

Venezuela’s 2023 TPS may qualify about 472,000 additional Venezuelan nationals for TPS. Initial applications began on October 3, 2023. All applications must be filed by April 2, 2025.

Venezuela 2021 TPS  important dates and deadlines

This applies to people who have: 

  • An approved TPS, or
  • An initial pending TPS application.
  • You do not need to submit a new application  if you have a pending:
  • TPS application, or
  • TPS-related Employment Authorization Document (EAD) application, and
  • the application was filed under Venezuela 2021 TPS.
  • Designation date: March 9, 2021
  • TPS designation extended through: September 10, 2025
  • Re-registration period: January 10, 2024 - March 10, 2024
    • Note: You must re-register for TPS yearly to maintain your benefits. The steps for re-registration are the same as applying.
  • EAD auto-extension through:  March 10, 2025

You must maintain a continuous physical presence in the U.S. since March 9, 2021. 

Venezuela 2023 TPS important dates and deadlines

This applies to people who: 

  • Have not filed for TPS, but
  • Want to file an initial application.
  • To be eligible, you must maintain a continuous physical presence in the U.S. since October 3, 2023.
  • Designation date: October 3, 2023
  • TPS designation through: April 2, 2025
  • Re-registration period: October 3, 2023 - April 2, 2025
    • Note: You must re-register for TPS yearly to maintain your benefits. The steps for re-registration are the same as applying.
  • EAD auto-extension: None
